These Terms of Service ("Terms") govern your use of the FireBackup online backup service operated by FireBackup LLC ("FireBackup," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms.
You must be at least 18 years old to use FireBackup. By using the service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and authentication tokens, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
FireBackup provides block-level network backup and restore services. You may use the FireBackup client software to back up data from your computers to our servers and restore that data when needed. You may also browse and manage your backups through our web interface.
Each account is subject to a storage limit of 1 TB. If your stored data exceeds this limit, new backups may be rejected until usage is reduced. We will make reasonable efforts to notify you before you reach your storage limit.

We do not proactively monitor the content of your backups. However, we reserve the right to suspend or terminate accounts that violate these Terms.
FireBackup is a paid service. Fees are billed in advance on a recurring basis as specified at the time of purchase. All payments are processed through PayPal.
If payment fails, we will attempt to notify you and provide a 30-day grace period to resolve the issue. If payment is not received within the grace period, your account may be suspended and your backup data may be permanently deleted.
All fees are non-refundable except as required by applicable law.
You retain all ownership rights to the data you back up using FireBackup. We do not claim any ownership interest in your data. We access your backup data only as necessary to provide the service, troubleshoot technical issues, or comply with legal obligations.
We use industry-standard measures to protect your data, including TLS/SSL encryption in transit and encryption at rest on our servers. While we take reasonable precautions, no system is completely secure. You acknowledge that you use the service at your own risk.
We strongly recommend that you maintain local copies of critical data and not rely on any single backup solution, including FireBackup, as your only copy.
We strive to maintain reliable service, but we do not guarantee any specific level of uptime or availability. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
FireBackup is provided on an "as is" and "as available" basis. We are not liable for any data loss, corruption, or inability to access the service.
You may cancel your account at any time by contacting us at support@firebackup.com. Upon cancellation:
We may suspend or terminate your account if you violate these Terms, fail to pay fees after the grace period, or if we are required to do so by law. We may also discontinue the service entirely with at least 60 days' notice. In the event of service discontinuation, we will provide you with a reasonable opportunity to retrieve your data.
To the maximum extent permitted by law, FireBackup LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the service.
Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid to FireBackup in the 12 months preceding the claim.
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that your data will be preserved without loss or corruption.
You agree to indemnify and hold harmless FireBackup LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Oregon.
We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email at least 30 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
